1-1. Acceptance of terms and conditions

The terms and conditions are the terms on which MISSHA NEW ZEALAND offers you access to the Services and the Website. By registering as a member of MISSHA NEW ZEALAND you accept these terms and conditions. If you do not accept these terms and conditions, you must refrain from using the Services.



1-2. Amendment of terms and conditions

These terms and conditions may be amended in whole or in part by MISSHA NEW ZEALAND from time to time. Amendments will be effective immediately upon posting of the amended terms and conditions on this Website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of the Services represents your agreement to be bound by the terms and conditions as amended.
 
These terms and conditions were last updated 10th September 2010.



1-3. Terminology

In these terms and conditions, the following expressions have the meanings settle out:

  • 'Item', 'Products' means goods that may be bought through the list in categories;
  • 'Customers', ’Members’ means a registered member of MISSHA NEW ZEALAND;
  • 'Services' means any one or more of the services offered by MISSHA NEW ZEALAND from time to time, including online order, shipping, message boards and any other service that Best and Most may offer;
  • 'we', 'us' ,’MISSHA NZ’ and 'our' are a reference to MISSHA NEW ZEALAND;
  • 'you' and 'your' are a reference to you;
  • 'Website' means any MISSHA NZ website through which the services are offered.

You expressly understand and agree that:
 
Your use of the services is at your sole risk. The Website and services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law and without limiting clause 2.2, MISSHA NEW ZEALAND disclaims and excludes all implied conditions or warranties, including, but not limited to, any warranties of merchantability, fitness for a particular purpose, and non-infringement;
 
Responsibility for the content of advertisements appearing on this Website (including hyperlinks to advertisers' own websites) rests solely with the advertisers. The placement of such advertisements on the Website does not constitute MISSHA NEW ZEALAND's recommendation or endorsement of the advertised product or service. Each advertiser is solely responsible for any representation made in connection with its advertisement.



2-4. Liability

You agree that, to the maximum extent permitted by law, any and all liability and responsibility of MISSHA NEW ZEALAND to you or any other person under or in connection with these terms and conditions, or in connection with the services, this Website, another Member's acts or omissions, or your use of or inability to use, the services or this Website, is excluded regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise. MISSHA NEW ZEALAND's liability and responsibility is excluded in respect of any and all loss or damage, whether direct or indirect, including, without limitation, loss of profits, loss of data, loss of business or anticipated savings, general and special damages, and consequential and incidental loss.



2-5. Indemnity

You agree to release, indemnify and keep indemnified us from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities, or demands suffered or incurred by us to any person arising out of or in connection with your failure to comply with these terms and conditions, your failure to complete a transaction, your use of MISSHA NEW ZEALAND's message boards, your sale or attempted sale of an item prohibited under clause 4.2(d), or arising out of any content or item you submit, post, transmit, or make available through the Services.



2-6. Breach

Without limiting any other rights and remedies available to MISSHA NEW ZEALAND, MISSHA NEW ZEALAND may limit your activities on the Website, remove your bids or listings, warn other members of your actions, issue a warning to you, suspend or terminate your membership, or refuse to provide our Services to you if you breach these terms and conditions or where MISSHA NZ considers it appropriate.



3. Shipping Rules & Restrictions

We only ship and receive orders within New Zealand.
 
Most orders begin the order process as soon as your online purchase is completed. Your order will be shipped once your payment is approved, the receiving address is verified, and the item is located in stock. If an item you order is not currently in stock, you will be notified by email and refunded if you have been charged.
 
If your order is being delivered to an office building, apartment complex or similar facility, or to a public institution such as a hospital, hotel or school, the carrier may accept the signatures of mailroom employees, receptionists, and similar administrative personnel upon delivery. Upon signature or acceptance by such personnel, we shall be deemed to have fulfilled our entire delivery obligation for your order. We are not responsible for lost or stolen items delivered in accordance with the delivery practices noted above.



4. Delivery

All orders delivered via FASTWAY (www.fastway.co.nz). The standard delivery time for Auckland area is 2-3working days and Nationwide is 2-5 working days. Shipping will be delayed if it is happened during public holiday or weekend time. Shipping and handling charges will be free to anywhere in New Zealand.



5. Order Status

You can check the status of your orders by accessing your account online 24 hours a day. Simply click the Login link at the top right hand side of the page and enter your email address and your password. Once you have logged in you can check the status of your order.



6. Payment Options - Money order

Money order simply means that you have to deposit the total amount of order to appointed MISSHA NZ bank account number. When the deposit is confirmed your order will be processed to packing.



7. Payment Options - Credit card

MISSHA gladly accepts Visa and Mastercard credit cards for payment for online purchases. Some orders may require a credit card authorization form to be completed and returned. Online orders are processed using the secure Hosted Payment page solution from DPS. Your card is authorized and debited in real time, in an SSL secure environment.



8. Retail Prices

All prices are displayed on the product page in New Zealand currency and are GST inclusive.



9. Cancellations

Occasionally, orders or parts of an order are cancelled by our system for various reasons. Some reasons are:

  • Where item(s) are not available.
  • Where there is difficulty in processing your payment information.
  • Where we cannot ship to the address provided.
  • Where a duplicate order was placed.
  • Where an order is cancelled due to a customer request.
 
If your order is cancelled, you will receive an important notice regarding your order via e-mail which will explain the reason for the cancellation. If the payment has already been made MISSHA NZ will be contacting you to confirm the way of refund. 10% penalty will be asked, if you change your mind for the products.



10. Returns and Exchanges

We are not able to refund items in money but can exchange them for same MISSHA products.
 
We are not able to exchange items simply because you have changed your mind about a particular purchase so please take a careful consideration when purchasing our product.
 
We at MISSHA NZ are totally committed to high quality and service to ensure your online shopping experience is good. We absolutely guarantee the quality of all our products. If however we erroneously send you the wrong item or faulty item we will be happy to exchange the goods that are returned to MISSHA NZ in re-saleable condition. I.e. unopened and unused in their original packaging returned to MISSHA NZ within 7 days of you receiving them. We will replace or exchange for same new product or item of equal price
 
All MISSHA products are dermatologist tested and contain only certified ingredients, however due to the nature of cosmetic products the results can vary for different skin types and skin conditions. We are not able to exchange used items that have caused an irritation, skin troubles or because the results are short of expectations. However we do provide free samples for products for customers to try before purchase and also can provide full list of ingredients if requested via contact us.
 
Goods are returned to MISSHA NZ at your own expense, however if goods are faulty then we will reimburse you for any postal and handling expenses. No additional shipping and handling charges will apply when exchanging to equal MISSHA products.
 
No refund or exchange is available for specially priced on sale items.



11. Online Security

Online orders are processed using the secure Hosted Payment page solution from DPS. Your card is authorized and debited in real time, in an SSL secure environment.



12. DPS Privacy Policy

DPS is committed to protecting the security of your data and uses a variety of security technologies and procedures to help protect your personal information from unauthorized access, use or disclosure. The personal information you provide is stored in computer servers with limited access that are located in controlled facilities secured by the latest in surveillance and security technology. When we transmit sensitive information (such as a credit card numbers) over the internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol. Credit card details stored on site are encrypted using 168bit 3DES encryption. DPS is also certified AIS compliant.
